倘若業主因應有關監管部門的指令而進行所需工程，而物業最終被市建局收購作重建之用，則業主應可就有關工程餘下的有效期申請發還有關支出款項。上述監管部門規定的工程包括屋宇署根據建築物條例第123條要求進行的樓宇維修或修葺工程消防處根據消防安全商業處所條例第502條要求進行的消防裝置或設備安裝或改善工程，以及機電工程署根據升降機及自動梯安全條例第327條要求進行的升降機工程或自動梯工程。
