In my view, the orders of our legal inheritance are too few, so i make a proposition that the daughter and sons as well as their direted - related descendants should be ranged as the first group, the parents, as the second group, the sisters and brothers as well as their daughters and sons, as the third group, the grand - parents, as the forth group, the spouse, as the ring who can share the inheritance right with any of the the above groups
在筆者看來，我國法定繼承的順序太少，建議把子女及其直系卑血親列為第一順序繼承人，把父母列為第二順序繼承人，把兄弟姐妹及其子女列為第三順序繼承人，把祖父母、外祖父母列為第四順序繼承人，配偶則可與各順序的繼承人共同繼承。關于配偶的應繼分，我國現行立法未規定先取權和用益權，對父母、祖父母、外祖父母等血親繼承人未規定遺產使用權，是其不足，應予補充、完善。
