本文通過對我國刑法法律解釋過程的實證考察，使用加達默爾哲學闡釋學、維特根斯坦語言分析哲學、哈貝馬斯的溝通與對話理論等哲學理論作為分析工具，指出了制約獲得正當的法律解釋結論的各種因素，提出應從方法和程序兩個方面保證正當結論的獲得。論文對具體的方法和程序進行了深入研究。
