Because there are no clear regulations about continuous writing in the current copyright law, there is no common agreement on whether continuous writing is tortious among scholars. it has done damage to the copyright holders ’ right as continuous writing become more and more common on the internet, which in turn gets in the way of knowledge flourishing and social development. this paper, begins with definition and characters of continuous writing, then goes on to analyze the nature of continuous writing based on legal theory and existing law, and build up a simple and effective continuous writing right and continuous writing priority system
本文在深入分析續寫作品的定義、分類及特徵后，又在法理和現行法的基礎上深入挖掘了續寫作品的侵權本質，在充分論證了續寫的利益性以及創設續寫權的必要性后，在認定續寫侵權性的前提下，將續寫行為分為對未完成作品的續寫和對已完成作品的續寫兩類，並為其構建對應的制度規范，續寫權和續寫優先權。
