在構成要件部分，筆者以各國票據立法為基礎，結合案例分析，重新闡釋了票據權利善意取得的四個構成要件，即有效票據轉讓行為、讓與人無處分權、受讓人善意和相當對價；在法律後果部分，筆者在強調了票據權利善意取得制度旨在調整真正權利人與善意受讓人的關系，使善意受讓人得以終局地取得票據權利，真正權利人不得對其請求回復和賠償之外，對該制度所引發的間接後果，即真正權利人與無處分權人、無處分權人與善意受讓人之間的利益分配和責任承擔進行了全面分析。 -
