未取得醫生執業資格的人擅自為他人進行節育復通手術、假節育手術、終止妊娠手術或者摘取宮內節育器，情節嚴重的，處三年以下有期徒刑、拘役或者管制，並處或者單處罰金；嚴重損害就診人身體健康的，處三年以上十年以下有期徒刑，並處罰金；造成就診人死亡的，處十年以上有期徒刑，並處罰金。
