Such an important figure as hart in the research of philosophy and law, yet he received so little attention in studying his theory as a whole. especially in the research of law, it is often blurred the relationship between hart ’ s new analytic jurisprudence which has integrated into the mainstream of general philosophical thought ( namely, ordinary language analytic philosophy ) and his theory of ordinary language analytic philosophy, because of the absence of the attention to hart as an ordinary language analytic philosopher. and there is room to discuss the inheritance, the change between new analytic jurisprudence and analytic jurisprudence and the relationship between analytic philosophy and analytic jurisprudence which are all named analytic
本文即試圖通過對這些分析法學家的法學思想及其所持哲學觀之間關聯的探討，對同以「分析」為名的「分析哲學」 、 「分析法學」以及「新分析法學」的不同「分析」觀進行梳理，指明哈特之於分析法學的貢獻乃在於日常語言分析轉向的實現，從而使我們可以通過理解語言來更好的理解法律，使眾多曾經困擾著我們的法學問題可經由細致地日常語言分析而得以澄明。
