為此，本文從影視表演藝術理論出發，論述了演員在影視作品中所處的不可替代的重要地位，並從演員在影視作品中的角色與自身、人格權與身份權的關系論述了演員角色不能覆蓋其自身，演員在影視作品中雖然沒有身份權，但仍享有人格權，為此，只要演員在影視作品中是以本來面目面對觀眾，符合肖像的法律特徵，就享有肖像權。
