基於此，筆者以樓花按揭法律制度為研究對象，對樓花及其按揭的淵源進行了考證，並對此制度的性質及其預告登記的效力定位進行了法律上的探討和評析;在此基礎上，還對樓花按揭制度中按揭權的實現問題以及令人關注的樓花按揭運作中各方當事人的常見風險作了深入的分析，並就其常見風險的法律防範和對策提出了自己的建議和設想，以期樓花按揭業務能有效、正常的運行，繁榮房地產金融市場，促進市場經濟健康、穩定和快速發展。
