論證舉證責任倒置的學者觀點明確並且論證十分充分的不多，相反卻是對此著書立說予以反駁的學者較為突出，如西南政法大學的副教授陳則博士，翻譯並介紹德國證明責任學說的吳越先生均是目前國內對舉證責任倒置持否定態度的代表人物，由於他們的推動使得國內持此說的人越來越多，但在《民事證據法（草案） 》的擬定過程中，並未采責任倒置的地位，這樣的立法選擇是建立在對我國法律實現的本土環境客觀認識的基礎上的科學選擇，誠然，舉證責任的分配直接影響到當事人在訴訟中的敗訴風險，而「倒置」規則的設計，則在此問題上增加了原告勝訴的籌碼，在理解何為舉證責任倒置時，本文著重以民事法為主線，指出這種「倒置」並非全部免除原告的證明責任，而是在一定范圍與一定程度上將通常應由原告負擔的舉證責任轉由被告從反方面承擔，舉證責任倒置在三大訴訟法中所體現的具體情形有所差異，但它們的內在精神是一致的?法律的理性與社會公平價值，在民事訴訟中舉證責任倒置的情形，一般總是將其局限於特殊侵權情形，而忽略了民事合同違約責任的訴訟中的原告也無須對被告應承擔違約責任的所有要件，對被告主觀上的過錯實行推定，若被告予以否定則應對其無過錯的證據舉證，在設置舉證責任倒置的規則時，從各國的立法經驗與法的內在價值要求可以總結出以下幾個原則:程序法與實體法結合原則，公平原則，訴訟經濟原則，保護弱者原則等，基於此完善舉證責任倒置的規則時首先應肯定舉證責任倒置的概念，其次立法應避免求大求全，再次要配合實體法的發展，最後還可以在司法領域嘗試判例的指導意義。As for the research method, after considering the existing approaches of foreign policy analysis, i chose the approach of comparative analysis. bush ' s foreign policy on iraq and his policy on the second nuclear crisis of korea peninsula are picked out to be compared. with the c omparison of several related variables, the research question will be answered and the relations between neoconservatism and bush ' s foreign policy will be concluded : instead of saying bush ' s foreign policy is manipulated by the neoconservatives, we had better say bush administration understands what kind of tone should be taken under certain circumstance
在探討了現有種種外交政策分析方法的適用性后，本文選擇了比較分析法，通過比較決定布希政府對伊政策和處理第二次朝核危機政策的重要變量，回答了研究問題，點明了布希政府採用新保守主義型外交所要具備的種種條件，並就新保守主義與布希政府外交得出結論：與其說布希「被新保守主義者劫持了」 ，還不如說布希政府能夠在合適的時機，利用新保守主義者的政策主張鮮明且具有煽動性的特點，為更好的實現自己的政策目的服務。The main content of the article is involved as follows : ( 1 ) the construction of system ' s frame and design scheme after the process of collecting experts " experiences and knowledge in the industry of plastic dies at home and abroad ; ( 2 ) concept structure of the whole database after the process of data abstraction and integration, which has previously been concept structure designed and the ensuring data model transferred to be supported by dbms, constructing 266 data files and inputting data ( data files referred to appendix 2 ) ; ( 3 ) the connection between web server and plastic die material database system realized by ado, odbc technology, which will guarantee the mutual information transportation between the database system and different terminals ; ( 4 ) interactive user interface of remote optimization selection es of plastic die material is built by asp technology on the server - side ; the construction of web server ; the functions that will enable clients to inquire information of plastic die materials in the database system by using standard db inquiry language ( program files referred to appendix 1 )
本課題的主要內容是以b s結構為基礎建立基於web數據庫的塑料模具材料遠程選擇優化專家系統，使異地終端能夠通過網路在客戶端進行塑料模具材料瀏覽查詢、塑料模具材料選擇優化等操作，系統可給出符合用戶條件的被選的主要材料的技術資料，如化學成分、熱處理工藝及性能等，以及一些被選材料在行業中實際應用的良好效果等資料，並組成用戶技術文件，以便於用戶進行材料購買、加工和應用；專業人員能夠進行相應的管理。本文重點作了下述工作： （ 1 ）收集國內外塑料模具行業專家經驗與知識，構造本系統的組成框架和設計方案； （ 2 ）對數據進行概念結構設計，經過抽象和集成得到整體數據庫的概念結構，進而將其轉化為dbms所支持的數據模型，建立了266個數據文件並輸入了相關的數據（數據文件名稱列表參見附錄2 ） 。
