    本文立足我國國情,借鑒國外經驗,以現代責任保險新理念為基本思考路徑,客觀分析我國責任保險立法對第三人保護現狀,極探討對第三人予以保護和救濟途徑,建議在我國保險法中建立第三人直接請求權制度和事故賠償基金制度,進一步推行強制責任保險,擴展責任保險范圍以及明確規范保險人、被保險人對第三人當履行義務,從整體到局部、從制度到措施,力求全、有效地構築我國責任保險第三人法保護屏障,充分實現責任保險基本制度價值。
