最高院司法解釋對法院調查、收集證據作出了最新規范，確立了依職權和依當事人、訴訟代理人申請調查兩種情形，並各有適用條件，它在發揮積極實踐作用的同時，也存在著合法性困境，以及其他適用中的理解、運用問題，為使法院調查行為立法及司法解釋目的發揮最大作用，應及時以立法形式賦予該司法解釋合法性，同時完善相關應規范，取消各地自行制訂的諸如調查令制度在內的不統一的證據調查規則，維護法制的統一性及公正性。
