然而，筆者認為：不斷加強的世界知識產權保護在某些方面對社會具有反作用力和有害；知識產權更多的是成為保護權利人經濟利益的手段（而非其原本目的） ，通過獲得一定時期的壟斷權，作為回報將其智力創造成果公知于社會，以促進創造力的方式；知識產權領域壟斷問題的日益加劇與知識產權保護的過度政府行為化進一步擴大了發達國家與發展中國家的矛盾，拉大了全球貧富國家之間的發展差距。
