Aimed at decreasing the loss of the country and people which are brought about by traffic accidents, the new criminal law pays special attention to the crime of causing traffic trouble, especially giving explicit and concrete regulations for escape behavior of traffic accidents, aggravating the sentencing range for escape behavior and increasing its striking force, therefore decrease the occurrence of escape behavior by the highest limitation
為此， 1997年《刑法》將交通肇事後「逃逸」和「因逃逸致人死亡」分別規定為交通肇事罪的加重處罰情節，最高人民法院通過《最高人民法院關于審理交通肇事刑事案件具體應用法律若干問題的解釋》 ，對兩者含義以及相關的認定問題做出了具體的規定。
