Member may provide that any request made under this section in connection with the use or registration of a trademark must be presented within five years after the adverse use of the protected indication has become generally known in that member or after the date of registration of the trademark in that member provided that the trademark has been published by that date, if such date is earlier than the date on which the adverse use became generally known in that member, provided that the geographical indication is not used or registered in bad faith
成員可做出規定:依本節而提出的任何有關（將地理標志作為商標）使用或注冊的請求，均須在受保護的地理標志不被作為地理標志使用在該成員域內已經為人所共知之後的5年內提出，如果該商標在注冊之日已被公布，並且公布之日早於上述「人所共知」之日，則須在該商標注冊后5年內提出，只要對該地理標志的使用或注冊不是惡意的。 -
