This article explores the theorical basement of probation of prosecution system mainly from philosophy, sociology, psychology and legal philosophy, and then analyzes it combining with the judicial practice of our country, then raises personal idea of constructing distinguishing probation of presentation system of our country
暫緩起訴的功能主要有過濾功能、預防再犯功能以及矯治功能。本文擬從哲學、社會學、心理學等視角出發，尋求建立暫緩起訴制度的理論依據，並結合我國司法實踐，提出構建有中國特色暫緩起訴制度的管窺之見。
