    筆者以全球性的生態危機使人類面臨生態困境的現實為進路，結合生態學、環境學、哲學、倫理學、環境法學、刑法學等學科知識，依循憲法和立法法的相關規范和「嚴而不厲」的刑事政策，提出並論證了: 「人類為了生存與發展，必須保護生態環境? ?善待自然、而設立生態犯罪? ?將嚴重破壞生態環境的行為納入刑法規范、以刑事法律支撐生態環境保護，是我國目前保護生態環境更為有效的選擇」這一論點。
