筆者認為，公共秩序與善良風俗是屬于不同范疇的兩個概念，公共秩序屬于政治國家的范疇，而善良風俗屬於市民社會的范疇，二者的差異性正是源於政治國家與市民社會的差異性，而對政治國家與市民社會的關系架構，歷史上存在著黑格爾的「政治國家高於市民社會的架構」和洛克的「市民社會先於或外于政治國家的架構」兩種模式，筆者描述了這兩種架構，提出無論是「政治國家高於市民社會的架構」還是「市民社會先於或外于政治國家的架構」都存在著明顯的缺陷，毋寧是二者間的平衡，所以構建一種市民社會與政治國家良性的互動關系比較合理。
