本文中，筆者結合刑法第一百三十三條的規定及最新通過的一些司法解釋，從交通肇事罪的犯罪構成入手，就駕駛非機動車輛肇事、在公共交通管理范圍外肇事的定性問題，有關司法解釋中關于交通肇事共同犯罪的合理性問題，交通肇事犯罪的精神損害賠償問題等進行了深入的探討，以期對今後的立法和司法解釋有所裨益。
