    在筆者看來，我國法定繼承的順序太少，建議把子女及其直系卑血親列為第一順序繼承人，把父母列為第二順序繼承人，把兄弟姐妹及其子女列為第三順序繼承人，把祖父母、外祖父母列為第四順序繼承人，配偶則可與各順序的繼承人共同繼承。關于配偶的應繼分，我國現行立法未規定先取權和用益權，對父母、祖父母、外祖父母等血親繼承人未規定遺產使用權，是其不足，應予補充、完善。
