摘要回顧一起關于信用卡冒用訴訟案的案例，結合工作實踐，立足相關的法律法規，提出關于「簽名爭議」的三個焦點問題，即商戶有無義務認真審查信用卡背面的簽名與pos單上的簽名一致；對于「密碼簽名」的信用卡，發生失竊、冒用等情況，在掛失前已產生非本人交易時，責任如何界定；對于由「簽名不符」引發的爭議，相關部門有無適用的法律依據。
