第三部分所有人抵押權的效力在這個部分，筆者從所有人抵押權的處分、抵押物的處分、抵押物在破產法上的別除權以及所有人抵押權的實行等四個方面分別對保有債權的所有人抵押權和不保有債權的所有人抵押權的效力進行了論述，認為所有人抵押權既然不是一種抵押權，當然無抵押權的固有效力，因而權利人不可以主動實行所有人抵押權，而抵押物仍然可以依法處分，保有債權的所有人抵押權，其抵押物在破產法上享有別除權，而不保有債權的所有人抵押權則不享有別除權。
