    鑒于以上問題的存在，筆者認為，應該在對脫離共犯關系理論進行正確理解的基礎上，在我國立法中體現其本質特徵，以「脫離共犯關系」作為認定部分共犯人犯罪中止的標準，將在共同犯罪過程中，自動停止了自己的犯罪行為，並作出了真摯努力去阻止犯罪結果的發生，卻由於自己無法控制的因素而沒能成功的部分共犯人認定為犯罪中止，並以中止犯的處罰原則來進行責任追究。
