    筆者從文化、法律文化、法律文化的沖突與變遷以及經濟法制度的法律文化土壤的思路進行研究,在理論分析的基礎上,基於經濟法形成與發展的特定背景與現實,闡釋經濟法以社會本位為價值取向、以權利與權力均衡為主旨、以平衡協調為內核、以為終極懷的內涵;經濟法文化的路徑考察由經濟法文化演進與國家角色的變遷、經濟法嬗變中的平衡協調精神、經濟法文化孕育中的社會本位思潮、經濟法文化熏陶下的經濟法制度催生個層面展開;經濟法文化的特性表現為現代性和民族性,經濟法文化與現代法治文明的聯涵蓋兩個方面,挖掘發揚傳統法文化中的合理因素、警惕傳統法文化中不合理因素的侵蝕;由於中西經濟法文化的產生與發展存在一定的差異,西方經濟法文化的發展表現為權利文化向權力文化的過渡轉型,筆者以德國和國經濟法發展的歷史性回顧與反思進行實證考察並結合西方的法社會學思潮研究與西方經濟法文化的內在聯系,同時圍繞東方經濟法文化進行探析,其表現形式是儒家文化,發展的過程表現為權力文化向權利文化的轉移,其中中庸文化是中國經濟法文化的底蘊。
