本文在簡要評述蒙古刑法立法的淵源后，指出現行《蒙古固刑法典（修訂） 》的規定具有具體明確的特點，並講述了現行《蒙古固刑法典（修訂） 》所體現的現代刑法思想：刑罰人道主羲原則；體現實行過限理論；在總則中明確規定速累犯；明確規定生產和調查研究中的合理風險行為不構成犯罪；六十歲以上的人犯罪不通用死刑；行刑社會化程度高；設立了有利於罪犯改造的前科消減制度等。
