Where, in the international phase, some parts of the international application have not been the subject of international search or international preliminary examination because the international searching authority or the international preliminary examination authority considers that the international application does not comply with the requirement of unity of invention prescribed in the patent cooperation treaty, and the applicant fails to pay the additional fee, whereas at the time of going through the formalities for entering the chinese national phase, the applicant requests that the said parts be the basis of examination, the patent administration department under the state council, finding that the decision concerning unity of invention made by the international searching authority or the international preliminary examination authority is justified, shall notify the applicant to pay the restoration fee for unity of invention within the specified time limit

    在國際階段，國際檢索單位或者國際初步審查單位認為國際申請不符合專利合作條約規定的單一性要求時，申請人未按照規定繳納附加費，導致國際申請某些部分未經國際檢索或者未經國際初步審查，在進入中國國家階段時，申請人要求將所述部分作為審查基礎，國務院專利行政部門認為國際檢索單位或者國際初步審查單位對發明單一性的判斷正確的，應當通知申請人在指定期限內繳納單一性恢復費。
