  4. 3 without prejudice to article 10. 2, a ground of relief under this clause relieves the party failing to perform from liability in damages, from penalties and other contractual sanctions, except from the duty to pay interest on money owing as long as and to the extent that the ground subsists

  5. The undersigned does hereby unconditionally guarantee to each holder the prompt payment of all amounts due on this i trument as and when the same shall become due whether by acceleration, exte ion or otherwise, and waiver any requirement that any action be taken agai t the maker or makers before enforcing this guaranty

  6. The undersigned does hereby unconditionally guarantee to each holder the prompt payment of all amounts due on this instrument as and when the same shall become due whether by acceleration, extension or otherwise, and waiver any requirement that any action be taken against the maker or makers before enforcing this guaranty

The property is sold in the present condition and on an “ as is basis ” subject to the terms and conditions herein contained and to the terms and conditions set out in the government lease or conditions ( as the case may be ) and the deed of mutual covenant and management agreement ( if any ) or any other deeds or instrument in respect of the property and to the payment of the government rent ( s ) or due proportion ( s ) thereof and the purchaser shall in the deed of assignment covenant for himself and his executors administrators and assigns to observe and perform the said terms and conditions and to pay the government rent ( s ) or due proportion ( s ) thereof and to indemnify the vendor in respect thereof

  9. If the advance payment has not been repaid prior to the issue of the taking - over certificate for the works or prior to termination under clause 15 [ termination by employer ], clause 16 [ suspension and termination by contractor ] or clause 19 [ force majeure ] ( as the case may be ), the whole of the balance then outstanding shall immediately become due and payable by the contractor to the employer

    如果在頒發工程的接收證書前或按第15條僱主提出終止，第16條承包商提出暫停和終止，或第19條不可抗力（視情況而定）終止合同前，尚未償清預付款，承包商應將屆時未付債務的全部余額立即支付給僱主。
  10. On the basis of the payment on account made by the party salved in accordance with the provisions of the preceding paragraph, the security provided under article 188 of this code shall be reduced accordingly

  11. The customer may instruct and authorise the bank on behalf of the customer to sell, assign, transfer or deliver any securities and to purchase additional investments in securities for the account and risk of the customer to be deposited with the bank under the terms of these conditions provided that the bank shall be under no obligation to purchase additional investments in securities unless arrangements satisfactory to it relating to the payment of the purchase price have previously been made and in this connection the bank is authorised to instruct such brokers, dealers or other agents who may be associated or otherwise connected with the bank as it may select in the absence of any instructions to the contrary

If party b refuses to be employed by the party a after graduation, or party b terminates the employment with party a without party a ' s consent or if the employment is terminated by reason of circumstances which are imputed to party b, party b shall compensate to party a one hundred and fifty percent of the total amount of the training cost ( including but not limited the tuition, transportation fees, board and lodging expenses and the intern - remuneration paid by party a ), and the retention under article 6 will not be paid

    學生乙方于取得碩士學位后，不同意受聘于甲方亞炬，或雖至甲方任職，但未獲甲方亞炬同意而提前離職或可歸責于乙方而終止僱用契約者，則乙方須賠償甲方所已支付之培訓費總額（包括學費、交通費、食宿費及實習費） 1 . 5倍，且第六條之保留款將不予核發。

    因本協議而引發的、或是與之有關、或是因使用或不能用而對公司提出的任何索賠要求，其累積總額決不允許超出在對公司引發索賠事件之前，公司為服務條款在一年期內即行支付的費用額度。
